LVMH and eBay six-year lawsuit ended in reconciliation

The world's number one luxury goods group LVMH and the eBay US e-commerce platform protracted lawsuit finally ended in reconciliation.

According to WWD reports, the two sides said in a joint statement on Thursday that they will join forces to protect intellectual property against online fakes, though the terms of the settlement are not disclosed. LVMH said the future of counterfeit luxury goods will be significantly reduced on eBay.

In 2008, LVMH Group sued the sellers on eBay for selling counterfeit luxury goods. The French court ruled that eBay should compensate LVMH for the loss caused by selling fake goods and unauthorized sales of genuine perfumes between 2001 and 2006 at a fine of 38.9 million euros .

After some tug of war, in 2010, the French appeals court sharply reduced the amount of the fine to 5.7 million euros.

In 2012, another court ruled that although the lower courts in France could decide the amount of compensation that eBay should bear on the UK and France websites, it did not have jurisdiction over the eBay U.S. website.

Finally, the two sides reached a reconciliation with global effectiveness, covering all LVMH brands and product lines.

The International Anti-Counterfeiting Coalition (IACC) launched a "Rogue Block" campaign to combat online fakes, teamed up with credit card companies to forcibly shut down online payment systems for websites selling counterfeit goods.

In the summer of 2013, IACC signed an agreement with Taobao, a subsidiary of China's Alibaba, to combat the sale of fake online goods.

According to the CEO of the Authentics Foundation, international luxury goods companies have an obligation to tell consumers how to authenticate themselves, but they are reluctant to do so, fearing that their brands will be associated with counterfeit goods.

However, luxury goods companies spend heavily every year hiring private detectives around the world to examine counterfeit issues.
